Terms and Conditions

Xter.net is a registered service mark of Xalt LLC (“XALT”) used for various Internet related services provided by the latter. Xter.net and Xternet.net are websites owned and operated by Xalt. Your access to, and use of the above mentioned websites and services (hereinafter - “Xter.net”) are subject to these Terms and Conditions and any other stipulations contained elsewhere on this website ("Terms and Conditions"), whether or not you are a registered Xter.net users.

1. What you must do:

Carefully read these Terms and Conditions which serves to outline your use of Xter.net. You understand these Terms and Conditions to be the basis of a legal agreement between XALT and you.

2. What you must not do

2.1 You must not:

• use Xter.net for any activities, or post or transmit to or via Xter.net, any information or materials which breach any laws or regulations of any country, infringe a third party's rights, or are contrary to any relevant standards or codes;
• use Xter.net in any way, or post or transmit to or via Xter.net, any material which interferes with other users or that defames, harasses, threatens, menaces, offends or restricts any person or that inhibits any other user from using or enjoying xter.net;
• use Xter.net to send unsolicited electronic mail messages to anyone;
• to make any fraudulent or speculative enquiries or requests using Xter.net;
• use another’s name, username or password;
• post, or transmit via Xter.net, any obscene, indecent, inflammatory or pornographic material or material that might give rise to civil or criminal proceedings;
• tamper with, hinder the operation of, or make unauthorized modifications to any software and information of Xter.net or any third party;
• knowingly transmit any virus or other disabling feature to Xter.net or any third party; and
• use Xter.net for implementing “voice-over-IP” or any similar functionality;
• attempt any of the above acts or permit another person to do any of the above acts.

3. Prices and services are subject to change

Use of Xter.net services is subject to charges and fees posted here and made available at the Xter.net Customer Support Center at Xternet Plaza, Moskovyan 33, Yerevan 375001, Armenia. The current prices may also be obtained by calling the Xter.net customer support line (+374 1 54 80 41). Xter.net reserves the right to change or institute new charges and fees at any time.

4. Xter.net Messaging Services

4.1 We provide messaging services via Xter.net . XALT will endeavour to ensure the continuity of its messaging services at all times and with all reasonable efforts.

4.2 We may reject any mail message sent to you, or by you, if:

• the size of the message (including attachments) exceeds 3MB;
• the size of the message (including attachments) when multiplied by the number of recipients of the message exceeds 3MB;

If we reject mail messages, we are not obliged to notify you or the sender of the message and its contents.

4.3 You are responsible for all equipment and software used to access the messaging services, and for the consequences of any filtering or other application you choose to apply to the messaging service.

5. Security

For security reasons we may require you to re-authenticate yourself to Xter.net from time to time, for example after a period of inactivity on the connection between your browser and the Xter.net servers. We are not responsible for any information you may lose if the Xter.net servers terminate your browser session due to prolonged periods of inactivity between your browser and the Xter.net servers.

6. Indemnity

You indemnify XALT and its officers, employees, agents and related bodies from and against all actions, claims, suits, demands, damages, liabilities, costs or expenses arising out of, or in any way, connected to the use of Xter.net.

7. Disclaimer and Limitation of Liability

To the extent permitted by law, neither XALT or any of our officers, employees, agents or related bodies will be liable in any way (including negligence) for any loss, damage, costs or expenses suffered by you, or claims made against you, through the use of Xter.net. Under any circumstance, the liability of XALT should not exceed to the last monthly amount charged to you by XALT.

8. Use of Your Information and Material

When you send us any feedback, suggestions, ideas or other materials in relation to Xter.net or XALT, you agree that we can use, reproduce, publish, modify, adapt and transmit them to others free of charge and without restriction, subject to the obligations contained in our Privacy Policy.

9. Changes

We may vary any of these Terms and Conditions at any time. We will give notice of any significant variations to registered users by email to the email address notified to us by the user. We will post notice of any significant variations for non-registered users of Xter.net at the newsroom page. Your continued use after the change will constitute acceptance of the variation.

10. Termination

If, in XALT's reasonable opinion, you breach any of these Terms and Conditions, we may suspend, terminate or limit your access to or any accounts with Xter.net. In such case, no refunds will be payable by Xter.net for any unused portions of the prepaid amounts.

11. Final Provisions

11.1 This agreement is governed by the law in force in the Republic of Armenia, and the parties irrevocably submit to the non-exclusive jurisdiction of the courts of Armenia for determining any dispute concerning this agreement.

11.2 If any of these Terms and Conditions are invalid or unenforceable, it will be struck out and the remaining terms will remain in force.

11.3 If we do not act in relation to a breach by you of these Terms and Conditions, this does not waive our right to act with respect to subsequent or similar breaches.
